Terms and Conditions

Last Updated: 30/9/2026

These Terms and Conditions govern your access to and use of the Quill & Colour website at https://quillcolour.com (the “Website”) and your purchase of products offered through it. The Website is operated by Quill and Colour Ltd, whose registered business address is 15 Azure Drive, Romsey, Hampshire, United Kingdom, SO51 7AN (“Quill & Colour,” “we,” “us,” or “our”).

Please read these Terms and Conditions carefully before using the Website or placing an order. By accessing the Website or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Website or place an order.

1. Eligibility and Use of the Website

1.1 Eligibility. You may use the Website and place an order only if you are legally capable of entering into a binding contract under the laws applicable to you. If you place an order on behalf of another person or business, you confirm that you have authority to bind them to these Terms and Conditions.

1.2 Permitted Use. You agree to use the Website only for lawful purposes and in accordance with these Terms and Conditions. You must not interfere with the Website’s operation, attempt to gain unauthorised access to any part of it, introduce malicious code, or use the Website in a way that could damage, disable, or impair it.

1.3 Website Information. We take reasonable care to ensure that product descriptions, images, specifications, and other information on the Website are accurate. However, colours and other product details may appear differently depending on your device or display settings. Information on the Website is provided for general purposes and may be updated or corrected without notice.

2. Orders and Contract Formation

2.1 Placing an Order. You may place an order by following the checkout process on the Website. Before submitting your order, you are responsible for checking that the products, quantities, delivery details, and other information are correct.

2.2 Order Acknowledgement. After you submit an order, we may send you an email acknowledging receipt. This acknowledgement does not mean that your order has been accepted. A contract is formed when we confirm that we have accepted your order, ordinarily by sending an order confirmation or dispatch notice.

2.3 Order Acceptance and Cancellation. We may decline or cancel an order before acceptance, including where a product is unavailable, there is an error in the product information or price, payment cannot be authorised, or we reasonably suspect fraud or misuse. If we cancel an order after receiving payment, we will arrange a refund of the amount paid for the cancelled order.

2.4 Product Availability. Products are offered subject to availability. If a product becomes unavailable after you place an order, we will contact you using the details supplied at checkout and, where appropriate, offer a replacement or refund.

2.5 Order Changes. Please contact us promptly at sales@quillcolour.com if you need to change or cancel an order. We cannot guarantee that changes or cancellations can be made once an order has been accepted or prepared for dispatch.

3. Prices and Payment

3.1 Prices. The prices and applicable delivery charges are displayed on the Website during checkout. Unless expressly stated otherwise, all prices and monetary amounts shown on the Website or in these Terms and Conditions are in US dollars ($). The final amount payable will be shown before you submit your order.

3.2 Price Errors. If we discover an obvious pricing or calculation error, we may contact you to confirm whether you wish to proceed at the corrected price or cancel the order. If we cannot contact you using the details provided, or you do not agree to the corrected price, we may cancel the order and refund any payment received.

3.3 Payment. Payment must be made using a payment method offered at checkout. By submitting payment details, you confirm that you are authorised to use the relevant payment method. Payments may be processed by third-party payment providers and may be subject to their terms and privacy practices.

3.4 Payment Security. We do not intend to store full payment card details. Payment information is handled through the payment services made available at checkout.

4. Delivery, Risk, and Import Charges

4.1 Delivery Information. Available delivery methods, estimated delivery times, and delivery charges will be displayed at checkout where applicable. Delivery estimates are not guaranteed, except where the law requires otherwise. We will use reasonable efforts to deliver your order within the estimated time.

4.2 Delivery Address. You are responsible for providing a complete and accurate delivery address and contact details. We are not responsible for delivery difficulties caused by inaccurate or incomplete information you provide.

4.3 DDP Delivery; Duties and Taxes. All orders are shipped Delivered Duty Paid (DDP). Quill and Colour Ltd pays all import duties, taxes, customs fees, and related import charges for your order. You will not be required to pay these charges to receive your order.

4.4 Risk and Ownership. Risk of loss or damage to a product passes to you when the product is delivered to you or to a person you designate to receive it. Ownership of the products passes to you once we have received full payment and the products have been delivered.

4.5 Delivery Issues. If your order has not arrived within the estimated delivery period, or arrives damaged or incomplete, contact us at sales@quillcolour.com with your order details. We will review the issue and take appropriate steps in accordance with applicable law.

5. Returns, Cancellations, and Refunds

5.1 Return Window. You may request a return within 14 days from the date of delivery. To request a return, contact sales@quillcolour.com and provide your order number and the reason for your request. The 14-day period is the period for requesting a return; it is not a substitute for any rights you may have under applicable consumer law.

5.2 Return Condition and Instructions. Unless the product is faulty, damaged, or incorrectly supplied, please return it unused and in its original packaging, with any included accessories. We will provide return instructions after receiving your request. Do not send a return to our business address unless we have instructed you to do so.

5.3 Faulty, Damaged, or Incorrect Products. If a product is faulty, damaged, or does not match your order, contact us at sales@quillcolour.com as soon as reasonably practicable. We will assess the issue and provide an appropriate remedy in accordance with applicable law. This section does not limit your statutory rights.

5.4 Refunds. If a refund is due, we will normally issue it to the original payment method unless another arrangement is agreed or required by law. Any refund will include the amounts that applicable law requires us to refund. We will notify you when a refund has been processed; the time it takes to appear in your account may depend on your payment provider.

5.5 Statutory Rights. Nothing in these Terms and Conditions limits or excludes any cancellation, return, refund, repair, replacement, or other rights you may have under applicable consumer protection law. Where mandatory law provides a right or remedy that is more favourable to you, that right or remedy will apply.

6. Product Information and Use

6.1 Product Descriptions. We aim to describe products accurately, including their materials, features, and intended use. Product images are for illustrative purposes and may not precisely reflect the appearance of the product in person.

6.2 Product Use. You are responsible for using and caring for products in accordance with any instructions or safety information provided with them. We are not responsible for damage caused by improper use, neglect, or failure to follow provided instructions, subject to your statutory rights.

6.3 Changes to Products. We may make minor changes to a product to comply with legal or safety requirements or to implement technical improvements, provided those changes do not materially alter the product you ordered.

7. Intellectual Property

7.1 Ownership. The Website and its content, including text, images, graphics, logos, designs, product materials, and software, are owned by or licensed to Quill and Colour Ltd and are protected by intellectual property laws.

7.2 Limited Permission. You may access and use the Website for personal, non-commercial purposes and may print or save reasonable extracts for that purpose. You must not copy, reproduce, distribute, modify, publish, commercially exploit, or create derivative works from Website content without our prior written permission, except where applicable law permits.

7.3 Brand Use. Nothing in these Terms and Conditions gives you permission to use the Quill & Colour name, logo, or other brand features without our prior written consent.

8. Third-Party Services and Links

The Website may include links to or features provided by third parties. These are provided for convenience only. We do not control and are not responsible for third-party websites, services, content, or policies. Your use of third-party services may be subject to separate terms between you and the relevant third party.

9. Privacy

We handle personal information in accordance with our privacy practices as described in the privacy information made available on the Website. By using the Website or placing an order, you acknowledge that we may process information as necessary to operate the Website, manage orders, provide customer support, and meet our legal obligations.

10. Disclaimers and Limitation of Liability

10.1 Website Availability. We aim to keep the Website available and functioning, but we do not guarantee uninterrupted or error-free access. We may suspend, withdraw, or change any part of the Website for operational, maintenance, security, or business reasons.

10.2 Non-Excludable Liability. Nothing in these Terms and Conditions excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any consumer rights that cannot be restricted by contract.

10.3 Liability for Products and Services. Subject to Section 10.2 and applicable law, we are responsible for providing products that conform to the contract and for performing our obligations with reasonable care and skill where required by law.

10.4 Excluded Losses. To the extent permitted by law, we are not liable for indirect or consequential losses that were not reasonably foreseeable when the contract was formed. This does not affect rights or remedies that applicable law makes available to you.

10.5 Business Use. If you use the Website or purchase products for business purposes, then, to the extent permitted by law, we exclude liability for loss of profits, revenue, business opportunity, goodwill, or anticipated savings arising from your use of the Website or purchase of products.

11. Events Beyond Our Control

We are not responsible for delay or failure to perform an obligation to the extent it is caused by circumstances beyond our reasonable control, including severe weather, natural disasters, public health events, war, terrorism, industrial disputes, interruptions to transport or communications, or government action. We will take reasonable steps to reduce the effect of the event and resume performance when reasonably possible. This section does not remove any rights you have under applicable law.

12. Changes to These Terms

We may update these Terms and Conditions from time to time. The current version will be posted on the Website with its “Last Updated” date. Changes will apply from the date they are posted, except that the terms applying to an order are those in effect when you place that order, unless a change is required by law or agreed with you.

13. Complaints and Contact

If you have a question, concern, or complaint about the Website or an order, contact us at sales@quillcolour.com. You may also write to:

14. Governing Law and Disputes

These Terms and Conditions and any dispute or claim arising from them or from your use of the Website or purchase of products are governed by the laws of England and Wales, except where mandatory consumer protection laws in your place of residence require otherwise. The courts of England and Wales will have jurisdiction, subject to any mandatory rights you may have to bring proceedings in another court.

15. General

15.1 Entire Agreement. These Terms and Conditions, together with the applicable order confirmation and any policies or notices expressly incorporated into them, form the agreement between you and us concerning your use of the Website and purchase of products.

15.2 Severability. If any provision of these Terms and Conditions is found to be unlawful, invalid, or unenforceable, that provision will be treated as modified to the minimum extent necessary or, if modification is not possible, removed. The remaining provisions will continue in effect.

15.3 No Waiver. If we do not enforce a right or provision immediately, that does not mean we have waived it. A waiver is effective only if given in writing.

15.4 Transfer. You may not transfer your rights or obligations under these Terms and Conditions without our written consent. We may transfer our rights or obligations where this does not reduce your rights under these Terms and Conditions or applicable law.

15.5 Third-Party Rights. Unless these Terms and Conditions expressly state otherwise, a person who is not a party to the contract between you and us has no right to enforce its terms.
